Founded in 2009, Capitol Escrow Services LLC was established on a principle of uncompromised neutrality and security. We are an independently owned and operated escrow agent, deliberately structured to be entirely free from any conflict of interest. We are not affiliated with any real estate brokerage, mortgage lender, title company, or financial institution. This independence is the cornerstone of our ability to serve as a truly impartial third party for every transaction.
Our operations are built upon a foundation of the highest regulatory compliance. As a company licensed by the State of New Mexico Department of Commerce, Division of Financial Institutions*, we adhere to a rigorous oversight framework designed for your absolute protection. This commitment is demonstrated through:
At Capitol Escrow, we believe that trust must be earned and demonstrated. Our regulatory framework is not just a requirement—it is our active pledge to provide a service defined by security, transparency, and reliability.
At Capitol Escrow Services LLC, we are the dedicated neutral third party that transforms uncertainty into closure. Our role is to administer transactions with precision, ensuring that funds and obligations are exchanged only when all agreed-upon conditions are met, thereby eliminating disproportionate risk for any party involved.
This is achieved through a disciplined framework that pairs cutting-edge security protocols with unwavering procedural integrity. Every transaction benefits from transparency, meticulous documentation, and systematic oversight from initiation to completion.
More than a service, we provide guaranteed performance. Our commitment, from our base in Santa Fe, New Mexico, is to deliver not just security, but also fairness and clarity—turning complex agreements into successful, trusted outcomes for every participant.
Our History
Founded in 2009, Capitol Escrow Services LLC was established with a clear vision: to bridge the gap in sophisticated, U.S.-standard escrow services for institutional capital entering México and Latin America. Recognizing the critical need for on-the-ground expertise, we strategically evolved as an independent entity, integrating seasoned partners within the region to build a truly binational service platform.
This foundational strategy of combining institutional rigor with local acumen has defined our growth. Today, we are the trusted escrow partner to a distinguished clientele, including premier law firms, major private equity investors, and leading financial institutions across the United States and México. Our history is not merely a timeline—it is a testament to building enduring trust where complex cross-border transactions demand nothing less.
Capitol Escrow Services LLC provides institutional investors and high net worth individuals with professional U.S. escrow services in Mexico and Latin America.
Experience makes the difference. The officers and legal agents that are part of our network go through what we believe to be the most rigorous vetting process in the industry. We Trusted Provider Seal validates the high quality standards we have met to be a Capitol Escrow Services LLC officer.
In order to qualify as a Capitol Escrow Services LLC Trusted Provider, an officer agent must:
Our U.S. escrow services provide a familiar process and enable our clients to securely settle transactions with safety, security and flexibility. As a U.S. company, we are subject to U.S. laws regarding the performance of escrow services as an intermediary. Our standard escrow agreements are governed by U.S. law.
We are skilled in transactions ranging from small condominiums to large, multi-site portfolios of commercial property. Real estate closing practices in Mexico and Latin America differ significantly from the standard U.S. processes. Our goal is to assist you in making your closing efficient and smooth, while ensuring that the terms of the escrow agreement are met.
Real estate settlement (commonly referred to as closing or escrow services) typically includes accepting funds and documents from the parties to the transaction pursuant to a written escrow agreement, and holding them for delivery to the proper parties when stated conditions have occurred.
We specialize in assisting clients with complex and demanding commercial real estate transactions, including multi-state and multi-property matters. We bring a focus and intensity that are unparalleled and our settlement professionals work diligently to cultivate our reputation for superior levels of client service. By employing leading technology solutions, we provide our clients and their advisors with convenient, efficient online communications regarding transaction status and other important closing matters.
Like our commercial settlement staff, our residential settlement teams have extensive experience in assisting buyers and sellers with complex transactions. We are committed to enhanced levels of communication through our online transaction management platform, which allows all parties to stay up-to-date on the real-time status of transactions. We tailor services and solutions to meet your needs.
The Title Insurance market in Mexico and Latin America continues to evolve. Capitol Escrow Services LLC can facilitate the purchase of a U.S. Title Insurance policy to protect against recording errors, liens, encumbrances, encroachments, taxes and boundary line disputes, plus fraud, misrepresentation, impersonation, secret marriages, incapacity of parties and undisclosed heirs.
The land transfer and “Notario Público” process in Mexico and other Latin American countries differs significantly from the U.S. system. In Mexico, a Notario acknowledges and certifies a property transfer, which provides “judicial certainty” as to the authenticity of the process. Without title insurance, a buyer may find it very difficult to recover monetarily for errors and omissions of a Notario Publico in the transfer process. Public registries in Mexico and most Latin American countries do not provide monetary indemnification in the event of loss due to a title defect or errors. As in the U.S., Title Insurance may be an effective tool to mitigate risk in mexican real estate transactions.
We understand the needs and concerns of Real Estate Developers in México and Latin America.
From hotels to maquiladoras, we have tailored customized escrow agreements and solutions to fit the needs of development projects. Prior to engaging with developer clients, we perform a detailed analysis of the proposed project and its needs.
We generally require that our developer clients commit to monthly or bi-monthly meetings with us to review escrow agreements, accounts and procedures for the project. Our processes are designed to ensure that the escrow procedure is secure, efficient and manageable for the developer, related buyers and Capitol Escrow Services LLC.
